Negotiation of CM Fee
After selection, public agency must “. . . negotiate a contract for those services at a fair and reasonable fee with the best qualified firm.” G.S. 143-64.31(a)
If unable to do so, negotiate with next best qualified firm.
Key Point: No bidding of fees by CM candidates.
